Permission is granted to electronically copy and to print in hard copy portions of this Web site for the sole purpose of placing an order with MicroAge Orland Park or using this Web site as a shopping resource. Any other use of materials on this Web site (including reproduction for purposes other than those noted above, modification, distribution, or republication) without the prior written permission of MicroAge Orland Park is strictly prohibited.

Privacy Agreement

MicroAge Orland Park is not in the practice of making any personal information regarding it's customers public unless so decreed by a court of law through proper legal channels and procedures. It is the responsibility of the customer to maintain the security of their account - including any and all passwords. Any transactions from your account are to be undertaken as your responsibility unless an unauthorized intrusion can be identified and documented by MicroAge Orland Park. The customer agrees to notify MicroAge Orland Park immediately if your account has been tampered with. In accordance to definitions established through the ECPA, MicroAge Orland Park should not be considered a secure communications facility and customers agree to use these services at their own risk.

Acceptable Usage Policy

By using our web hosting services, you agree to comply with our acceptable usage policy. We expect you to possess a basic knowledge of the Internet and computer function. We also expect you to have access to a computer, which is connected to the Internet to use our services. The spirit of this policy is to guide you to use the MicroAge Orland Park service with due regard to the rights of other Internet users and in conformity with special MicroAge Orland Park network environment.

Illegal Usage

MicroAge Orland Park servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to MicroAge Orland Park service agrees to indemnify and hold harmless MicroAge Orland Park from any claims resulting from the use of the service that damages the subscriber or any other party.

MicroAge Orland Park will be the sole arbiter as to what constitutes a violation of this provision.

Adult Content

Due to special system and network requirements of adult oriented sites, pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.

Security

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks, forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resources

Any website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource used to an acceptable level. MicroAge Orland Park shall be the sole arbiter of what is considered to be a high server usage level.

All shared web hosting accounts come with a limit of 5000 files per account. Each block of 5000 files after the initial 5000 will be charged at $9.95/month rate.

Any hosting account deemed to be adversely affecting the server performance or the network integrity will be shut down without prior notice.

CGI Scripts

Cgi script sharing with domains not hosted by MicroAge Orland Park is not allowed. Any cgi-scripts deemed to be adversely affecting the server performance or the network integrity will be shut down without prior notice.

Chat Rooms

MicroAge Orland Park does not allow clients to install their own chat rooms. Chat rooms tend to be large system hogs and we cannot permit it as an account option. MicroAge Orland Park does provide a choice of Java chat rooms for a small extra charge that should meet most users' needs and run without hindering the performance of the machine of our servers.

Background Running Programs and Cron Jobs

MicroAge Orland Park may allow programs to run in the background. These programs will be considered on an individual basis and extra charge will be incurred based on system resources used and operational maintenance needed. If you wish to run background programs please contact us at support@maop.com before doing so.

IRC

MicroAge Orland Park does not allow IRC or IRC bots to be operated on our servers.


UCE (Unsolicited Commerce Email) - SPAM

Spamming, or the sending of mass unsolicited email, from or through a MicroAge Orland Park server or using an email address that is maintained on a MicroAge Orland Park machine is STRICTLY prohibited. MicroAge Orland Park will be the sole arbiter as to what constitutes a violation of this provision. If you engage in any of the foregoing activities using the service of another ISP or IPP, but channeling activities through a MicroAge Orland Park server as a mail drop for responses, you are in violation. Violators will be assessed a minimum of $200.00 fine and will face an immediate suspension.

Server Abuse

Any attempts to undermine or cause harm to a MicroAge Orland Park server or customer of MicroAge Orland Park is strictly prohibited.

Any sub-networks of MicroAge Orland Park and dedicated servers must adhere to the above policies. The failures to meet or follow any of the above guidelines are grounds for account deactivation. We reserve the right to remove any account without prior notice.

Software Distribution

MicroAge Orland Park shared Web Hosting accounts are not to be used for the purposes of distributing software and multimedia products. If you wish to distribute software and/or multimedia files, please contact mgmt@maop.com for a special arrangement.

Multimedia Files

Multimedia files are defined as any graphics, audio, and video files. MicroAge Orland Park Web Hosting accounts are not to be used for the purposes of distributing and storing unusual amount of multimedia files. Any Web site whose disk space usage for storing the multimedia files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of multimedia files.

Database

Any database stored on MicroAge Orland Park servers shall be limited in size to 10% of the total disk space allotted for a particular domain.


Actions Taken by MicroAge Orland Park

When MicroAge Orland Park becomes aware of an alleged violation of its Acceptable Use Policy, MicroAge Orland Park will initiate an investigation. During the investigation MicroAge Orland Park may restrict Customer's access in order to prevent further possible unauthorized activity. Depending on the severity of the violation, MicroAge Orland Park may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies. If such violation is a criminal offense, MicroAge Orland Park will notify the appropriate law enforcement department of such violation.

MicroAge Orland Park does not issue service credits for any outages incurred through service disablement resulting from Policy violations.

Modifications

MicroAge Orland Park reserves the right to add, delete, or modify any provision of any Policy at any time without notice.

Warranty

MicroAge Orland Park makes no warranties, expressed or implied, regarding services provided. We are not responsible for any damages suffered from the use of our services, including but not limited to, loss of data, service interruptions and/or delays, or third party litigation.

Responsibilities for Minors

Because MicroAge Orland Park has no control over the content available over the Internet, the customer certifies that he/she is at least 18 years of age or, if the customer is a parent or guardian, he/she assumes all responsibility for supervising the online activities of the underage user. Any information garnered through MicroAge Orland Park is done so at your own risk.

Complaint and Enforcement

In the event of a violation of any terms and/or conditions set forth in this agreement, MicroAge Orland Park reserves the right to immediately terminate the services provided, with the customer being fully responsible for any and all attorney's fees incurred by MicroAge Orland Park with regard to this agreement.
